Terms of Service

These terms outline the agreement between you and VisaPortal Solutions Ltd., setting out the standards, rights, and responsibilities governing our immigration advisory and overseas services.

1. Acceptance of Terms

By engaging the services of VisaPortal Solutions Ltd. (“VisaPortal”, “we”, “us”), submitting consultation questionnaires, retaining our advisors, or browsing our website, you (“Client”, “Applicant”, or “You”) agree to be legally bound by these Terms of Service.

If you do not agree with any portion of these terms, you should immediately refrain from utilizing our portals and retaining our advisory services.

2. Scope of Consultancy Services

VisaPortal provides non-governmental advisory and procedural support including:

  • Immigration eligibility assessments and case profile evaluations.
  • Guidance on visa categories (Skilled Work Permits, Business & Investor Visas, Visitor/Tourist Visas, Student Visas, and Family Reunification).
  • Document review, translation coordination, formatting, and submission dossier preparation.
  • Interview preparation coaching and consular biometrics booking assistance.
  • Sourcing verified overseas employment opportunities under National Employment Authority (NEA) regulated guidelines.

3. Sovereign & Consular Disclaimers

IMPORTANT NOTICE REGARDING IMMIGRATION DECISIONS:

VisaPortal Solutions Ltd. is a private professional immigration consultancy and licensed employment agency. We are NOT an embassy, consulate, or government immigration department.

The sole authority to approve, issue, delay, or deny any visa, work permit, entry clearance, or travel authorization rests exclusively with the relevant government sovereign body (e.g. UKVI, IRCC, Australian DHA, US Department of State, Schengen Consular Posts, UAE Federal Authorities).

While VisaPortal maintains a high success track record by adhering to strict legal and regulatory standards, no consultancy can guarantee a visa outcome. Any representation suggesting guaranteed issuance is strictly disclaimed.

4. Client Obligations & Document Authenticity

The client explicitly agrees, warrants, and represents that:

  • All information, academic certificates, financial statements, employment histories, and identification documents provided are 100% genuine, authentic, and accurate.
  • Submission of fraudulent, forged, or altered documentation is a criminal offense under Kenyan and international law. VisaPortal reserves the right to immediately terminate the retainer without refund and report forged submissions to relevant authorities.
  • The client is responsible for disclosing any prior visa refusals, deportations, criminal records, or medical conditions that may affect eligibility.
  • The client must adhere to timelines for document submission and attend required biometric appointments promptly.

5. Fee Structure & Payment Terms

All consultancy service fees are agreed upon in writing via a Service Level Agreement (SLA) or Consultation Retainer before the commencement of casework.

  • Consultancy Fees vs Government Fees: Our service charges cover case evaluation, file preparation, advisory, and document handling. Official embassy visa fees, biometric charges, medical exams, police certificates, and translation costs are external statutory fees payable directly to respective authorities.
  • Payment Schedules: Payments must be executed through our authorized corporate banking channels or official M-PESA paybill accounts. Official receipts are issued for all transactions.

6. Refund & Cancellation Policy

  • Initial Consultation Fees: One-on-one strategy sessions and assessment fees are non-refundable once the advisory consultation has been conducted.
  • Case Work in Progress: Once documentation review, drafting, or application submission has commenced, professional retainer fees are earned and non-refundable.
  • Consular Denials: In the unlikely event of a visa refusal, consultancy fees remain non-refundable as the service performed was the professional preparation and submission of the case file. However, VisaPortal will conduct a complimentary refusal analysis and provide reapplication advisory where viable.

7. Overseas Recruitment Standards (NEA & ASMAK)

For international labor placement and work abroad campaigns, VisaPortal operates under full accreditation by the National Employment Authority (NEA) and is an active member of the Association of Skilled Migrant Agencies of Kenya (ASMAK).

We strictly uphold ethical recruitment practices, ensuring transparent employment contracts, pre-departure orientations, verified employer attestations, and compliance with the Kenyan Employment Act.

8. Intellectual Property & Confidentiality

All proprietary templates, assessment systems, guides, and website materials are the intellectual property of VisaPortal Solutions Ltd.

We maintain strict confidentiality regarding client case records, financial details, and personal histories in accordance with our Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by Kenyan law, VisaPortal Solutions Ltd., its directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages resulting from:

  • Decisions, delays, policy changes, or quota revisions by foreign embassies or immigration departments.
  • Missed flight bookings or travel arrangements made prior to the physical receipt of a valid visa.
  • Errors or misrepresentations in documents provided directly by the client.

10. Governing Law & Dispute Resolution

These Terms of Service and any contractual agreements between VisaPortal Solutions Ltd. and its clients shall be governed by and construed in accordance with the Laws of the Republic of Kenya.

Any dispute, controversy, or claim arising out of or relating to these terms shall first be subject to good-faith mutual mediation. If unresolved, it shall be submitted to the exclusive jurisdiction of the competent courts in Nairobi, Kenya.
